Fall Petite Family Sessions

For the past nine years, these annual fall petite sessions have been like a family reunion! These sessions are designed to be short, simple, and focus on simply updating your family portraits.

I am working on securing a private property or off of West Broad Street at Battelle Darby Metro Park. The parks in Columbus mid September through early November are completely jam packed with other photographers. Parking becomes a nightmare as well as how overcrowded the park can be with the best spots typically "camped out and claimed" by others. My goal the past few years is to find a beautiful, private location where none of this is an issue and to keep things as stress free as possible!

By selecting a time and paying the $50 non-refundable, non-transferable retainer, you agree to the following:

THIS AGREEMENT IS PUT INTO PLACE TO SECURE A PHOTO SESSION WITH AMANDA ESTEP PHOTOGRAPHY AND TO ENSURE OUR EXPECTATIONS HAVE BEEN COMMUNICATED. PLEASE READ THIS ENTIRE CONTRACT CAREFULLY. IF YOU HAVE ANY QUESTIONS, PLEASE LET ME KNOW. THANK YOU AND I LOOK FORWARD TO WORKING WITH YOU!

AGREEMENT, JURISDICTION & SEVERABILITY

This contract contains the entire understanding between Amanda Estep Photography and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties. The laws of the State of Ohio shall govern this contract, and any resulting arbitration shall take place within Madison County, Ohio. Client assumes responsibility for all collection costs and legal fees incurred by Amanda Estep Photography should enforcement of this contract become necessary. In the event that any part of this contract is found to be invalid or unenforceable, the remainder of this contract shall remain valid and enforceable. Any failure by one or both parties to enforce a provision of this contract shall not constitute a waiver of any other portion or provision of this agreement.

1) PAYMENT TERMS AND CONDITIONS: The photography session will cover up to 20 minutes. The Client understands and acknowledges that the $50.00 non-refundable and non-transferable session retainer is due upon selection of preferred time and payment. Balance of $200 is due in full within 48 hours of photography services being rendered.

2) RETAINER: Client understands that a non-refundable, non-transferable retainer of $50.00 is required to reserve Photographer’s services for the agreed upon date(s) and time(s). The non-refundable retainer is non-transferable to other sessions and non-transferable to another party for use with Amanda Estep Photography.

3) CHARGEABLE TIME & TARDINESS: Chargeable time begins at the scheduled, agreed upon time and concludes up to 20 minutes after. Arriving late to your session will result in less time allotted for your session and potentially result in less images available. No communication of any kind to Amanda Estep Photography, no returned communication, or cancellation within 48 hours of the session date will result in the clients forfeiture of any and all monies paid to Amanda Estep Photography due to the nature of petite sessions.

4) RE-SHOOTS & REFUNDS: Re-shoots and refunds will not be given for but not limited to poor choices of clothing, unhappiness with choice of clothing, self esteem views with ones body and how it photographs despite the best efforts of the photographer, make-up or hair issues, individuals not smiling or participating the way the client(s) had envisioned; non-cooperation or hostility from any or all parties involved including but not limited to tantrums, fits, stubbornness, crying or screaming fits, throwing objects, hitting or smacking the photographer, spitting on the photographer, making faces at the camera while the photographer is attempting to photograph an individual(s). There is zero tolerance for unkind, demeaning, hostile, or threatening language whether it is directed at Amanda Estep Photography, parent to child, significant other to significant other, etc. Such behavior will be an automatic end to the session, no refund of any kind, and permanent ban on any future sessions with Amanda Estep Photography. No re-shoots or refunds will be given for but not limited to gallery delivery extension of time due to circumstances out of the control of Amanda Estep Photography such as but not limited to personal illness, family illness, hospitalization, accidents, acts of God, fire, flood, or computer issues.

5) MODEL RELEASE: The CLIENT hereby assigns Amanda Estep Photography the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included for social media platforms, website and blog, for editorial, advertising or marketing, educational purposes while mentoring photographers; to alter the same without restriction; and to copyright the same without restriction. The CLIENT releases all claim to profits that may arise from use of images.

6) MODIFICATIONS: If the client has a request for a small alteration of an image, please let Amanda Estep Photography know before you place your order or download digital files. The photographer can address minor changes at no cost (fix blemishes, tighter crop, etc.), but more involved requests are billed at $30/hr. Amanda Estep Photography will let the client know if there will be extra charges before work begins. Once the requested changes are made, charges apply regardless of whether the final product is purchased. The final post production editing styles, effects, and overall look of the images are left to the discretion of Amanda Estep Photography.

7) LIMITED LIABILITY: In the unlikely event that the photographer from Amanda Estep Photography is unable to perform to the guidelines of this contract due to but not limited to an injury, illness, act of God, act of terrorism, or other cause beyond the control of Amanda Estep Photography, then Amanda Estep Photography will make every reasonable effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the scheduled photography session. In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond Amanda Estep Photography's control, including but not limited to camera, hard drive, or equipment malfunction, Amanda Estep Photography's liability is limited to the return of all payments received for the photography session not including the non-refundable retainer fee. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. Amanda Estep Photography is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package or one year.

8) PRIVATE PROPERTY: If sessions are held on and hosted by a private property owner, Client agrees to abide by the property owners rules, requests, etc. such as but not limited to parking in designated areas, not picking flowers out of flower gardens, and not climbing/sitting/standing/etc. on items, vehicles, farm equipment, etc. the owner wishes to be left alone. Client understands that private property owners designate certain areas that may used safely and are within everyones best interests. If Client disregards the rules and requests made by the private property owner, the private property owner and or Amanda Estep Photography reserve the right to have Client removed from the premises and no refunds of any kind will be given. The private property owner cannot and will not be held responsible for any and all consequences of willful acts of negligence made by the Client.
